1. Acceptance of Terms

By accessing and using VoiceListAI (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

Important: You acknowledge that AI can make mistakes, generate inaccurate content, and produce errors. By using VoiceListAI, you accept these inherent limitations of artificial intelligence.

2. Description of Service

VoiceListAI is a voice-first AI tool that helps eBay sellers create product listings. The Service:

  • Transcribes voice recordings into text
  • Analyzes product photos via AI
  • Generates product descriptions using AI language models
  • Creates eBay listing attributes using AI
  • Posts listings directly to eBay (with your authorization)

AI-generated content: All descriptions, titles, and attributes generated by VoiceListAI are produced by artificial intelligence. While we strive for accuracy, AI can:

  • Misidentify product features
  • Generate grammatically incorrect text
  • Create misleading or inaccurate descriptions
  • Produce inappropriate content
  • Fail to capture important product details

You are responsible for reviewing, editing, and verifying all AI-generated content before posting to eBay.

3. User Responsibilities

You agree to:

  • Provide accurate product information
  • Review all AI-generated content before posting to eBay
  • Edit and correct any inaccuracies in AI output
  • Comply with eBay's policies and guidelines
  • Not use VoiceListAI to create fraudulent, misleading, or illegal listings
  • Not use the Service to post counterfeit, stolen, or prohibited items
  • Maintain the confidentiality of your account credentials

4. Limitations of AI

VoiceListAI uses artificial intelligence that:

  • May misinterpret audio or misidentify products
  • Can generate plausible-sounding but false information
  • May struggle with accents, background noise, or unclear speech
  • Cannot verify factual accuracy
  • May produce biased or stereotypical descriptions
  • Is not a replacement for human judgment

You acknowledge and accept these limitations. The Service is provided "as-is" without guarantees of accuracy or reliability.

5. Disclaimer of Warranties

The Service is provided on an "as-is" and "as available" basis. VoiceListAI makes no warranties, express or implied, regarding:

  • The accuracy or completeness of AI-generated content
  • That the Service will be error-free or uninterrupted
  • That AI-generated descriptions will comply with eBay policies
  • That using the Service will increase your sales or improve your business
  • That the Service will meet your specific needs or expectations

6. Limitation of Liability

To the maximum extent permitted by law, VoiceListAI shall not be liable for:

  • Any errors or inaccuracies in AI-generated content
  • Any damages resulting from posting incorrect or misleading listings
  • Suspension of your eBay account due to policy violations
  • Loss of sales or revenue
  • Damage to your business reputation
  • Any direct, indirect, incidental, or consequential damages
  • Any claims by eBay, buyers, or third parties
  • Your failure to review AI-generated content before posting

7. Indemnification

You agree to indemnify and hold harmless VoiceListAI from any claims, damages, or losses arising from:

  • Your use of the Service
  • AI-generated content you post to eBay
  • Your failure to review or edit AI-generated content
  • Your violation of eBay policies
  • Your posting of inaccurate, fraudulent, or prohibited items
  • Any disputes with eBay buyers or eBay itself

8. Payment & Billing

  • Basic plan: $27/month USD, up to 200 listings sent to eBay per month
  • Pro plan: $45/month USD, up to 500 listings sent to eBay per month
  • eBay similar item check has a daily limit, which is higher on Pro. Fair use applies, and accounts that abuse it may be limited or suspended
  • Payments processed by a third-party payment processor
  • Cancellation anytime (subscription ends at next billing cycle)
  • No refunds except as required by law

9. Termination

VoiceListAI may terminate or suspend your access if you:

  • Violate these Terms of Service
  • Post fraudulent or prohibited listings
  • Violate eBay policies repeatedly
  • Engage in illegal activity
  • Abuse the Service or its infrastructure

Termination is effective immediately. No refunds will be issued for suspended accounts.

10. Third-Party Services

VoiceListAI integrates with third-party services:

  • eBay API: Listings are posted directly to your eBay account, and photos you choose for eBay similar item check are sent to eBay to find similar items. Prices shown are asking prices, not sold prices
  • AI service provider: Powers all text generation and image analysis
  • Payment processor: Processes all payments
  • Hosting provider: Hosts the Service and stores your account and listing data
  • Email provider: Sends contact-form notification emails

You are responsible for reviewing and accepting the terms of these services. VoiceListAI is not liable for:

  • eBay account suspension
  • Changes to eBay policies
  • AI service errors or limitations
  • Payment processing issues
  • Data breaches or security issues

11. Data & Privacy

12. Intellectual Property

  • You retain ownership of your product photos and voice recordings
  • VoiceListAI retains ownership of the AI models and Service code
  • You grant VoiceListAI a non-exclusive license to use your audio/photos to generate descriptions
  • eBay retains ownership of your listings once posted to their platform

13. Governing Law

These Terms of Service are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Texas, USA.

14. Changes to Terms

VoiceListAI may update these Terms at any time. Your continued use of the Service constitutes acceptance of updated terms. We will notify you of material changes via email.

15. Data Retention & Draft Impermanence

An in-progress listing is kept only in your own browser on the device you are using, and it can be lost if you clear your browser data or switch devices. Photos are uploaded to storage as you add them, but the title, description, price, and other field values you speak or type are only saved to your account when you click "Save as Draft" or "Post to eBay." If you do not do so, your unsaved field values may be permanently lost.

16. Mobile Data Usage

Voice recording, photo capture/upload, and AI analysis consume mobile data, particularly when uploading multiple high-resolution photos over a cellular connection. You are solely responsible for any data charges billed by your mobile carrier while using the Service. We recommend using Wi-Fi when uploading photos or running AI analysis on a metered connection.
